Terms of Use
The short version
- Shinobu helps you build habits. It isn’t medical, fitness or mental health advice, so train within your limits.
- Shinobu Pro renews automatically until you cancel in your iPhone’s Settings. Apple handles billing and refunds.
- You must be 13 or older to use Shinobu.
These Terms of Use (“Terms”) are an agreement between you and Cobi Hilliard, the developer of Shinobu (“Shinobu”, “we”, “us”). They cover the Shinobu iPhone app and this website (together, the “Service”). By downloading or using the Service, you agree to these Terms. If you don’t agree, please don’t use it.
1. Who can use Shinobu
You must be at least 13 years old to use Shinobu. If you’re under 18 (or the age of majority where you live), you need a parent or guardian’s permission, and they agree to these Terms for you, including any purchases.
2. Your license
We give you a personal, non-exclusive, non-transferable, revocable license to use Shinobu on Apple devices you own or control, as allowed by the Apple Media Services Terms and Conditions. You may not copy, modify, reverse engineer, resell or redistribute the app, or use it to break any law.
3. Your data and content
What you enter into Shinobu (your vow, signature, habits and history) belongs to you and is stored on your device. See our Privacy Policy. Because we don’t keep a copy, you are responsible for your device’s backups. We can’t restore data that is lost or deleted.
When you share a card made in Shinobu, you’re responsible for where you post it. Our name, logo, art and rank emblems remain ours. You may share cards made in the app for personal, non-commercial use.
4. Shinobu Pro and subscriptions
- Purchase. Shinobu Pro is available as an auto-renewing subscription (monthly or yearly) or a one-time lifetime purchase. Prices are shown in the app before you buy and may vary by country.
- Payment. Payment is charged to your Apple Account when you confirm the purchase.
- Auto-renewal. A subscription renews automatically at the same price and length unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
- Free trial. If a free trial is offered, you are charged when it ends unless you cancel at least 24 hours before. Any unused part of a trial ends when you buy a subscription.
- Managing and cancelling. Go to Settings on your iPhone, tap your name, then Subscriptions. If you cancel, you keep Pro until the end of the period you’ve paid for.
- Refunds. Apple handles all billing, so refund requests go to Apple at reportaproblem.apple.com. We can’t issue refunds ourselves.
- Restoring. If you reinstall the app or get a new iPhone, tap Restore purchases in the app with the same Apple Account.
- Price changes. If a subscription price changes, Apple will let you know in advance, and you can cancel before the new price applies.
5. Health and safety
Shinobu is a tool for building habits. It does not give medical, fitness, nutrition or psychological advice. Talk to a doctor before starting any new exercise, diet or demanding routine, and stop if something hurts or doesn’t feel right. Rest when you need to. You choose your habits and you’re responsible for doing them safely.
Shinobu is not a crisis service. If you’re struggling or thinking about hurting yourself, please reach out to someone now: in the US, call or text 988; elsewhere, find a free, confidential helpline at findahelpline.com.
6. Changes to the Service
We are always improving Shinobu, so features may change, be added or be removed. If we remove a feature you paid for while your subscription is active, we’ll aim to give you something of similar value or tell you how to request a refund from Apple.
7. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent allowed by law, we make no warranties of any kind, whether express or implied, including that the Service will be uninterrupted, error-free or meet your goals. Reminders and widgets depend on your device and iOS, and may not always show up on time.
8. Limitation of liability
To the fullest extent allowed by law, we won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, streaks or progress, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for Shinobu in the 12 months before the claim, or US$50, whichever is greater. Some places don’t allow these limits, so they may not apply to you.
9. Ending these Terms
You can stop using Shinobu at any time by deleting the app. We may suspend or end your access if you break these Terms. Sections 3, 7, 8, 11 and 12 survive after these Terms end.
10. Apple
These Terms are between you and us, not Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app; Apple has no other warranty obligation to the extent allowed by law. Apple is not responsible for handling any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection claims or intellectual property infringement claims. You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
11. Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules. If you live in the EU, UK or another place that gives you consumer protection rights, nothing in these Terms takes those rights away.
12. Changes to these Terms
We may update these Terms from time to time. If we make significant changes, we’ll update the effective date above and let you know in the app. If you keep using Shinobu after the changes take effect, you accept the new Terms.
